Needing to request discovery from respondent in a civil case. Under what state statute would this request be governed by.

Also, if you are not sure of the rules, you might not want to "do it yourself" in terms of the details. But yes they are not under the statute but under the Rules of the Supreme Court of Virginia. Requests for Admission are also permitted, but few people seem to have figured that out yet.

In Virginia, discovery requests are normally propounded under the authority of the Rules of the Supreme Court of Virginia, Rule 4:8 covering requests for interrogatories and 4:9 for documents, respectively.
One can also utilize the Subpoena Duces Tecum to secure documents in civil cases in the General District Court.
