Legal Question in Civil Litigation in Virginia

robbed by merchant

I was in a well known department store and purchase 2 items with my checkcard. I used the card as a debit so the funds would come out of my bank immediately. Once the purchase went thru and the cashier was giving me my receipt the computer shut down. The manager of the store took the items from me and insisted that I didn't pay for the items. I called my fiancial institution and the funds were taken out. I tried to let manager of the store hear the automated system from the bank but they refused. It escalated as far as them grabbing the items and almost calling the police. They told me I was stealing if I left w/the items and they were not going to let me leave w/the items. I ended up leaving the store because my young child was with me and I was embarrassed and humiliated in from of a lot of people. I ended up getting so upset that I had to go to the urgent care to find out that my blood pressure went up to 150/100. Now the merchant has my items and my money. Can I go after this company for what they have done?

Yes, you should immediately demand the return of your money or the items, one or the other. And, if neither is forthcoming, then file suit in small claims court. (You also might wish to discuss the incident with the supervisor(s) of the store manager, if there be such before taking the matter to small claims.)
