Legal Question in Civil Litigation in Virginia
Selling a truck left on property
I have a truck that is sitting in my car port waiting to be fixed. A guy I work with bought the truck from my friend and he has been storing it in my car port and rebuilding it every now and then. I want it off my property, but am getting the run around from the guy I work with. My friend is giving me the title to the truck and I want to know if I will get in trouble legally, if I remove the truck and sell it or sell it for scrap metal. The guy from work has never paid any storage fees and it has been sitting since July 2004. Please help!

Re: Selling a truck left on property
If you were to attempt to sell the truck it could invite unanticipated and vexatious legal problems for both you and your friend who would have unadvisedly transferred the title to you rather than to the ostensible purchaser who presumably paid him a quantity of good coin of the realm for the vehicle.
It would likely be far simpler for you to simply have the vehicle towed away from your property to the property of the one who supposedly purchased the vehicle.
If you are intent upon recouping the fees for towing and storage you could file your case with the small claims court.(I reiterate that I would not attempt to sell the vehicle under the circumstances which you've described in order to recoup these costs.)
