Legal Question in Civil Litigation in Virginia
Shipping insurance
Breakable package inspected/approved for shipment at local chan representing UPS as a drop-off station. [UPS policy - breakable items must be left open for inspection]. Receiver claimed damage. Contacted me [e-mail] upset UPS insurance reimburse me not her. Receiver purchased item for $100 below the retail/insured value.
Contacted UPS, e-mailed her their instructions[repack just as shipped] UPS would pick up Monday. She contacted UPS Monday; given same instructions. When returned paper was the only wrapping material in the box. Shipped with paper, peanuts, and bubble wrap.
UPS designated the pkg a "partial discard, balance returned". Denied payment improper packing, returned to the local drop-off who informed me they'd look into the matter, they'd only been respresenting UPS a couple of months & were not familar with UPS policy in such matters & informed me the employee, operations manager who did the inspecting, was no longer with them & they could not verify packing.
Today the manger at the local drop-off that originally inspected/approved
shipment informed me it did not meet UPS requirements & no reimbursement is due. Could you give me some directions on how to proceed?

Re: Shipping insurance
Sorry about your loss. I believe the first place to begin is with the contract. Read the document and check all applicable definitions and terms. Then see if you can arrive at a resolution with the insurer. There is always the option of contacting the Commissioner of Insurance and seeing if they can help.
