Suing a Home Builder in Virginia

Can a Virginia home builder be sued for:

1. Not disclosing how close a highway is to the house which is causing severe noise pollution and

2. Not disclosing how close the next door neighbor's house will be from our house(less than 13 ft)?

Sure the builder could be sued(as almost anyone can be for almost anything these days), but if you really mean can the builder be successfully sued on these two grounds, I would answer no to both.
