Legal Question in Civil Litigation in Virginia

Vacation Pay after termination...

I have been accused of job abandonment and at the time had 29 hours of Vacation Time. The handbook says that you will not get vacation time if you are let go for misconduct or disciplinary action. Does job abandonment fall under these categories? I didn't abandon my job, but that's a different situation. Sick time is the only time we will not get paid whether involuntarily or voluntarily terminated.

Re: Vacation Pay after termination...

Alleged abandonment of a job by an employee would very likely qualify as a disciplinary action (or an action for which an employee could be disciplined) under the employer's handbook regulations. Furthermore, Virginia employers are under no obligation to provide either paid vacations nor sick leave to their respective employees, absent contractual provisions requiring them to do so.
