Legal Question in Civil Litigation in Virginia
Vehicle possession and ownership
I obtained a car loan for a used vehicle for a friend back in October 2007. The friend was supposed to make monthly car payments to me and I'd send the payments to the finance company; however, the friend has yet to make a single payment to me. It is now March 2008 and I have been making the car payments to protect my credit. The friend always comes up with an excuse as to why they can't make the car payment with a promise to bring me the money for the previous 4 payments. There are only 1 set of keys and the friend still has possession of the vehicle.
The vehicle is registered to me only but my friend was carrying the insurance on the vehicle. After the friend failed to make the first 2 months of payments, I decided to add the vehicle to my own automobile insurance policy to ensure coverage in the event of liability or physical damage claims.
I'd like to know what are my options to obtain legal possession of the vehicle?

Re: Vehicle possession and ownership
Assuming that your "friend" would refuse your lawful demand to turn the vehicle and keys over to you, you could as the lawful owner of the vehicle hire a repo man to seize and turn it over to you who could then have a set of keys made once it's in your possession.
Re: Vehicle possession and ownership
If you purchased the vehicle from a used car dealer as recently as last October, the dealer may still have a record of information regarding the key specifications that would allow
you to have a duplicate set of keys made that would permit you to bypass the repo man option and just go and pick up the vehicle yourself, if you would be so inclined to do so.
