Legal Question in Civil Litigation in Virginia

Warrant in Detinue

Me and my sister lived in a house together, that is owned by my brother, we didn't get along, I moved, when I returned, she changed the locks on the door, I could not retrieve my personal property. I went to the local county courthouse, and I was told that I would have to file a Warrant in Detinue. I have a court date later this month. She put my personal property, outside, two days ago, and because of weather it was damaged, do i still go to court? or will i have to take her to small claims court?

Re: Warrant in Detinue

You already are in small claims court if you are in gerneral district court on the warrant in detinue. You could try to amend that pleading to include a damage claim for yor furniture. If the court will not let you do that, and assuming all of your property was returned you may have to start over again.
