Legal Question in Civil Litigation in Virginia
Water damage liability in a condominium
Condo association bylaws state owners are responsible for plumbing problems. A recent leak in my plumbing (unseen by me, no way of knowing it was there) damaged 2 downstairs residents. I immediately filed claims with my homeowners insurance. They say I am not liable. Condo assoc. says I am. I need to know how to protect myself in case this can't be resolved. Can a bylaw overrule an insurance claim?

Re: Water damage liability in a condominium
You might want to consider asking your insurance carrier why they think that you have no liability for the particular damage caused by your leaking pipes to these other condo units. (It would be my surmise that even if the bylaws were silent on this particular issue that you would still be liable for the damages caused by your leaking pipes.)
