Legal Question in Civil Litigation in Virginia

My wife and I were charged in Virginia with stalking by a former tenant. In court all charges were dismissed. Can we sue the former tenant for the expenses that we incurred (legal fees, lost wages, mileage to and from court and the attorneys office)

Depending on the facts, you might be able to pursue a malicious prosecution claim against your former tenant. If you prevail, you could recover the legal fees you incurred in defending against the stalking claim.
