background check delay green card interview
I applied green card for my mother while she is living abroad. US consulate abroad has received her package from NVC a year ago but still said she was under background check. Recent request about the case status returns the following reply. '' We have sent a follow-up request to the Department of State for expediting your mother's case in February 2007, but have received nothing yet. We will follow up again a couple of months later if your mother's background check hasn't been completed yet.'' Is there anything I can do to fight with that? Complaint to ''Office of International Operations'' ? or ''Office of Internal Audit''? or even court?(with what reason?) Thanks!

There could be many factors involved which are causing a delay in processing
your mother's papers, not the least of which could be the country where the background check of your mother must be conducted (of which you provide no clue).
Diatribes and vexatious complaints scattershot among the American immigration bureaucracy will likely avail you of little or nothing. However, a polite note asking for a status update every couple of months until lawful permanent residency status is formally conferred upon your mother, might possibly produce quite a lot in terms of positive results. (As the fabled saying goes: the squeaky wheel usually is the one that gets the attention---and, I might add---as long as the squeaks are not overly loud and unnerving.)
