Legal Question in Immigration Law in Virginia
Changing of visa status from H4 to F1and then to H4
Hi,
I am on H4 dependent visa right now on which I cannot work in US.I have done Bachelors in computer science from India.I want to change it to F1 student visa so that I can study(Masters program)and work too as I will get CPT also from Nothern Virginia University on which I can work legally from Jan,07.I will file for H1 in April,07 to start working from OCT,07.Is there a risk here that US immigration may reject my application for H1 in april since I changed my visa to F1 just before 4 Months in Jan,07? Should I take a risk to apply for F1 in Oct,06 from H4 visa and then apply for H1 in April,07 or I should not apply F1 but just wait until April and straight apply for H1 from H4 Visa.
Please help me with this Problem.

Applying for an F1 student visa in order to take advantage of an educational opportunity in October 2006 should have no effect on your subsequent application for an H1 visa in April of 2007.
