Legal Question in Immigration Law in Virginia

E visa

1/I am a french citizen and I want to start a e-business in the us.. my husband is french also and working on a h1b visa. What is the best for me :

- getting a h4 visa, get incorporated, begin the process and then ask for the e2 Visa

- getting a b1 visa, same process and then get the e2

2/During the processing period (so before I have the e2 visa), I will have to raise funding through venture capitalists, do I have the right to do it ????? or is it better for me to begin to raise capital when I have my e2 visa.

On the E-2 visa you will need to show prior to attempting the visa that you have made a "substantial" investment in the United States which is determined on a case by case basis. In addition, many embassies have their own particular documents for use in evaluating and processing E-2 visa applications. In connection with obtaining an E-2 visa, I would suggest that before you do anything, you retain an Immigration lawyer in your area. If you don't know any contact the American Immigration Lawyers' Association in Washington, D.C. They will give you the names and addresses of attorneys near you with whom you may consult.
