Legal Question in Immigration Law in Virginia

Employment related question

Hello,

I have a question, can you please help me in this.

I have signed with my employer that I cant work for any of the client / vendor / partner he introduced me. Presently I am working for Nike corp. There are 4 layers between my employer (Man power consultancy) and Nike.

In detail, my employer forwarded my resume to Comp A (Ashitha technologies), and Comp A forwarded my resume to Comp B (R-Tech source inc), and comp B forwarded my resume to Comp C (E-Accent tech) and Comp C forwarded my resume to comp D (In-source inc) and comp D is prime vendor to Nike.

1. Can I transfer my H1B to In-source inc?

2. There is no direct relation between my employer and In-source inc.

What he was arguing with me that, he show Nike with different layers and as per contract I was not supposed to work for Nike as he showed me. I am arguing with him that he introduced me to R-tech source inc not Nike / In-source inc. From R-tech source they introduced to their clients.

Thanks

Lalitha

Re: Employment related question

Sure, see if In-source will agree to formally sponsor you for an H1B visa and whether USCIS will agree to the transfer. (However, you still may have a legal problem with Nike if you had in effect a noncompete agreemnt with them which in their view you are violating by working for one of their prime vendors.)
