Legal Question in Immigration Law in Virginia

Green Card Hindrance?

I'm a foreign national who's now out of status. I recently got married to a US citizen and he's about to file the necessary documents on my behalf. However 3 years ago I was charged with a class 1 misdemeanor (petit larceny) and want to know if that will hinder my chances of getting through with my green card.

Re: Green Card Hindrance?

Quite possibly, since petty larceny is considered by USCIS as a crime involving moral turpitude(CIMT), and which could be a basis for having you served with a Notice to Appear for removal proceedings before an Immigration Court.

No, is not possible. Under USCIS rules and Law, is a crime. You can't qualify.
