Legal Question in Immigration Law in Virginia

Greencard expiration

Gentlemen,

I obtained my green card in 1985. It doesn't have an expiration date. We've moved several times since 1985, and I've never updated my address with the immigration office.

My question is twofold; Since I didn't keep my address updated, will that effect my eligibility in seeking citizenship?

I am planning to apply for my citizenship now. Do I need to update my green card first before beginning the process?

Thank you for your prompt response,

Re: Greencard expiration

As long as you can sufficiently document your continuous presence in the United States required for naturalization, it shouldn't be a major problem, and you are probably better advised to now go for citizenship rather than green card renewal.

Re: Greencard expiration

In direct response to question number 1, your failure to maintain a valid address with CIS can result in deportation charges. See INA 237(a)(3)(A). It is highly unlikely that CIS would charge you with this, but you should know about it.

In response to your second question, you must have valid, unexpired status document at all times. See INA 264(e). Based on your representation, your document meets that requirement. It is not necessary to renew that card unless you need to renew your drivers license. Many states are requiring green cards with expiration dates prior to issuing new driver's licenses.
