Legal Question in Immigration Law in Virginia
Hello,
I am the wife of an american citizen, came here on a fiancee visa. In Jan 2010 i went to the interview and passed it succesfully. I received my green card in the mail sometime later, with a issue date for 04/09/2010 to expire on 04/09/2012. I thought i was going to receive a reminder about the removal of condition.
My questions are: Do i receive a reminder from USCIS or do i just have to go ahead and apply for removal of condition on my own? Which is the date i have to take in consideration: the interview date, when i was approved for green card or the issue date on the green card?
Thank you in advance for your help.

Hi,
You should apply for removal of conditions on your own within 90 days of expiration date (04/09/12) irrespective of whether or not you receive a reminder from the USCIS.
My colleague is correct. USCIS may or may not issue a reminder notice to file a petition to remove the conditions on your permanent residence. If they fail to do so, this will not excuse your obligation to file the petition. If you are no longer with your spouse, your obligation is not relieved and you may be eligible for a waiver. If this is the case, make sure you consult with a qualified immigration lawyer.
