Legal Question in Immigration Law in Virginia

hi -- my husband entered the usa 2001 using his brothers passport, his first attorney he paid $8,000 when he first came into the country to register him and file proper papers to get green card, which the attorney never did, he is in jail now. the second attorney who came highly recommended is also now in jail..we were approved the I-130 but denied the I-485 twice. is there anything we can do or is he considered here illegal and will never be able to get a green card, he's from pakistan and showed police records from the abuse and beatings he was getting that's why he was so desperate to get out of pakistan if you don't join a party the parties become abusive. now with everything going on in pakistan he fears being sent back there, my husband is a hard worker, pays taxes -- what can we do thanks

If your husband can demonstrate a well founded fear of persecution in his

home country of Pakistan based upon the required criteria, he may be able to petition successfully for asylum (in the event that he has already not attempted such and been denied).

Sometimes is possible if he has proofs and request for a 'pardon'. He must ask for the 'pardon' at US Embassy explaining his case with details. Is not sure, but is an option. An answer takes, more or less, 3 months. Details: www.uscis.gov
