Legal Question in Immigration Law in Virginia

ICE Detainer

My boyfriend was just taken in

because he was driving without a

license. At this point we found out

he will not be released because he

has an ''ICE DETAINER''. He has

been in 24 hours and that's all they

are saying is he has no bond for

that detainer. He isn't in there for

legal charges of the license, they

gave him his tickets for that and

court dates and it was minor, he

should of been released, they are

holding him on the ICE DETAINER

they said. He has no aggrevated

felonies or drug charges, etc. He

has plenty of legal family here, a

steady job and an address. My

question is, are they going to

release him until the hearing or are

they not going to release him?

What are his chances of getting out

until his hearing on immigration or

whatever happens next, he has not

been spoken to by anyone yet,

they are just holding him here at

the county jail on an ''ice detainer''.

No, in my opinion your boyfriend has virtually no chance of being released from this immigration detainer and will undoubtedly be soon served with papers(if such has not already occurred)formally placing him in removal proceedings.

He should retain the services ASAP of an attorney who is appropriately knowledgeable and experienced in deportation defense.
