Legal Question in Immigration Law in Virginia
immigrant visa
If I apply for an immigrant visa and and got my visa, would i have to marry an American citizen to recieve my greendcard or do i recieve it immmediatly after being in the U.S.

First of all, you do not apply for an immigrant visa; a petition must be filed for you, or you fall under one of the self-petition visa categories. Either a family member, an employer sponsor, petitions for you. When that is approved, you obtain an immigrant visa. When you are out of the country, you will be interviewed by the Dept. of State at the U.S. Embassy. If you are found admissible, that is, you have a good background and you do not fall under any category which would prevent you from entering the United States, you will receive a package. When you get to the airport,you will be inspected. If all is found in order, your passport will be stamped w/evidence of your lawful permanent residence. Now, tell me why you think you would have to get married when you get here? The only category that would apply to would be to the fiance category, a K1 visa. So, tell me, what are the facts here. No, not if it was an employment based application
for your so-called "green card", but in no case would your receive it immediately after arriving in the United States. (To receive this kind of employment based lawful permanent residency, you would most likely have to first apply for a non-immigrant visa such as an H1-B).
