Immigration Divorce & Remarrage

Hi My lady is a wonderful kind & a Loving special lady. We want to get married. She will have to divorce her husb - it will be uncontected & in her case will be able to divorce with 6 months separation. He ex to be was extreemly Controlling & abusive mentally. Was always threating her will anything he could think of. She has smartened up we found one another & are deeply in love. We believe her legal husb of 4 years is seeking to withdraw his petition for support for her. We know he has written nasty things about her to INS .She doesn't have perm status yet & has an Interview scheduled for june 08. same day she is to take the test for Citizenship as well they say the Interview will be just prior to the Citizenship . Our plan is to finalize the divorce & marry. What typically happens when U do this. Anyone know? I talked to an attourney & he said it might not be a big deal, but failed to give needed details. Sd to talk to a Immigration Lawyer. Would love to know some details here.

Your "loving special lady" would likely be well advised to hold off on the divorce at least until after

she has her interview with USCIS next June. (If USCIS comes to the conclusion that her marriage to her current husband was not genuinely entered into for the right reasons, she

might not succeeed in getting her lawful permanent residency visa(green card) and a divorce initiated by her before this happens will almost guarantee the withdrawal of her husband's sponsorship of her application for green card status and further complicate matters for her.
