Legal Question in Immigration Law in Virginia

immigration/spousal abuse

Im an irish citezen living in US for 7 yrs. I became pregnant and married the father for the sake of baby and my immigration status. My baby is now 2 mos old. My greencard is coming shortly. Ive come to realize my husband is mentally unstable, verbally abusive and completely irrational. I need to get out of this situation. What rights do I have as far as moving back to Ireland with my child. How will my immigration status change. What rights does he have in regards to stopping me from leaving the country with my baby?

Re: immigration/spousal abuse

Since you're the child's mother and natural parent, you can leave the U.S. with the child for Ireland anytime, absent a court order either preventing or imposing precedent conditions on such a move.

However, if you continue to reside in Ireland or elsewhere abroad, you will likely at some point forfeit your lawful permanent residency (green card)status.
