Legal Question in Immigration Law in Virginia

Listing children on N-400 Form

I have a friend who is completing his N-400 natualization form and needs to list all his children in one section. He is married and has 2 kids with his wife of 20 years, which both live with them. He also has 1 other child of another lady who is still a minor (this happened because he cheated on his wife). The child does not have him listed as the father on his birth certificate, but does have his last name. He wants to know if he should include him as one of his children since there is no ''official'' record that he is his father other than changing his last name. He does provide him with monthly child support, but there is no written agreement/court orders. Please advise. Thanks.

Re: Listing children on N-400 Form

Failure to list this child could be expansively construed by USCIS as an untruth or misrepresentation and might even be used as a basis to deny your friend's petition for naturalization.
