Legal Question in Immigration Law in Virginia

Marry J-1 Visa Holder

I have been dating a J-1 Visa holder for 4 months now. We have discussed getting engaged in June of next year and then marrying In Sept of 2008. Her current J-1 visa runs out in Feb 2007 and has been reapplied for. She is beginning a 6 month internship that could extend to 18 months as a vet (already has her DVM) in training and the school will get an extension for her. What steps can we begin to keep her in the USA so that we can continue our 2 year courtship before marriage without her needing to leave the USA?

Re: Marry J-1 Visa Holder

One of the first things to determine is whether she is subject to the 2 year foreign residency requirement as many J-1 participants are, which would definitely impact your plans. I would highly recommend that you and your fiancee meet with an experienced immigration attorney to discuss her options and determine whether she is subject to the 2 year foreign residency requirement before making long term plans.
