Legal Question in Immigration Law in Virginia

Marrying someone with an expired visa

My girlfriend and I want to get married. Her visa expired over 10 years ago. She has been living in the US for 15 years. I am retired military, if that has any bearing on things. Would like to know if getting married is possible, and would she have to go back to Guyana.

Re: Marrying someone with an expired visa

As long as you are US citizen, she can prove that she entered legally, that you can support her and she has no criminal record you should be able to sponsor her. There are obviously some details that your attorney will discuss with you to make sure the filing goes smoothly. If you want to discuss your case in more detail feel free to contact us for a consultation.

Yes, you may marry your girlfriend and sponsor her for her lawful permanent residence, as long as she can prove she entered legally with her US visa.

You'll also need to show you make sufficient income as reflected on your last IRS tax returns.
