Legal Question in Immigration Law in Virginia
my petitioner has passed away. she is my mother. can i file for the obama homeland security appropriation law that was approved oct. 29, 2009 or i have to wait for the regulations?

It is not necessary to wait to file until regulations come out. There were some immigration laws passed in 1996 that still don't have regulations! The question is more whether you really qualify or not. I'm so sorry to know of your mother's passing, mine passed away too when I was pretty young, so I understand. Not everyone's parent who has died can qualify under the widow/widower law. Children can sometimes but not always qualify. If you can't qualify, you can still apply for humanitarian relief. This is discretionary and not as sure as qualification under the law you mention, but it's better than no other options, for sure.
