Legal Question in Immigration Law in Virginia

Political Asylum

I am from Nepal F-1 status. My family (wife and two children) are back home in Nepal. I wish to apply for political asylum because I feel insecure to go back home to due my political opinion. If my political asylum petition is denied, will my current F-1 status remain or will I be deported. Second, if my asylum petition is approved can I bring my wife and children over to USA? Please help me in clarifying this doubt?

Re: Political Asylum

If your asylum petition is denied by USCIS, your F-1 (student) visa status would continue as long as you've remained in status and your I-94 does not specifiy any particular departure date.

Yes, if you're granted lawful permanent residency by way of an asylum petition, you would then be able to sponsor your wife and children for similar status (lawful permanent residency).
