Legal Question in Immigration Law in Virginia
Reckless driving and citizenship
I got an out-of-state speeding ticket for reckless driving in VA in 1998. I'm preparing my N400 application.
Do I still need to report this ticket in N400 as this happened more than 10 years back?
If yes, do I need to need to provide documentation? Will the DMV be able to provide me the docs as I was an out-of-state driver and i have moved two states since.
Will it affect my citizenship application?

Re: Reckless driving and citizenship
Depends upon what questions are being asked on your naturalization petition (N400),and, consequently, what you're likely required to report. Depending upon how this charge was officially disposed of, you could have a record of a conviction for a traffic infraction or a Class 1 misdemeanor criminal offense resulting from this particular incident.

The main document that the adjudicator will be using to assess your character is the truthfulness on on the form. Secondly, you are require to affirm under penalty of the law that the information on the form are correct. Do not lie or misrepresent information on the form. If you do, you will be giving the adjudicator good reason to deny your application.
Report the ticket. The County/city/Police/sheriff/DPS in the area when you got ticket or where the ticket was disposed off will provide you with the necessary documentation which will reflect available information in their file. If they no longer have any information on you they will state so in the documentation of your records in their area.
If you provide the documentation you will help the adjudicator to make on the sport informed decision on your application. Otherwise, you will be be contributing to delay or denier of your application.
