The I-601 waiver of inadmissibility due to misrepresenation would involve a situation where the alien now seeking a visa had previously used fraud or other illegal means to enter the United States and now must receive this particular waiver in order to enter legally.

The law requires that the qualifying U.S. citizen spouse or fiance of the alien in this situation must prove "extreme hardship" in order to gain this waiver of inadmissibility for the alien, and which is vaguely defined as "greater than the normal hardship that the qualifying relative can be expected to experience if the Alien is denied admission."
