Legal Question in Insurance Law in Virginia
Accidental Drowning
My brother passed away on July 4, 2008. He was found drowned in a pool located at his friends house. Is there any case for suing thier homeowners insurance. The accident occured in Louisiana

Re: Accidental Drowning
Yes, there might very well be such a basis, but it would likely involve suing directly these friends who owned the pool rather than their insurance company. (The insurance carrier then, if required to do so, would have their attorneys defend the suit against the holders of the homeowner's insurance policy.)
It's also possible that the pool manufacturer as well as the pool distributor could also share in the liability for this accident.
Your parents or other legal guardian(s)of your deceased brother should arrange to consult with a Lousiana attorney who handles personal injury and wrongful death matters in that particular state for further advice on this unfortunate incident.
