Legal Question in Insurance Law in Virginia
Cobra
I'm a widow with a disabled daughter who started receiving SSI disability January 06 when she turned 18. Daughter covered since Apr 06 by COBRA through my ex-empl. I dropped COBRA & purchased other for myself. Depend. eligible for Medicare Jan 08. COBRA ends Oct 29 07. Been told by HR at ex-empl that in order to continue COBRA I had to notify them within 60 days after she was declared disabled which would have been impossible (look at dates). Can they refuse to continue her COBRA coverage until Medicare kicks in? ehealthinsurance agent did not recommend short term policy for COBRA to Medicare gap.

Re: Cobra
Generally, you only have 60 days from a qualifying event to elect COBRA.
