Legal Question in Insurance Law in Virginia
Coming after me for settlement Options?
I was involved in an accident in a work truck i was at fault and found to a non-permissive user my insurance co settled everything but my policy does not cover the truck my ex-employers insurance co has filed a warrant in debt against me I cannot pay at this time and I've heard bankruptcy is not an option. My questions are 1.does pleading poverty do any good in court (generally) 2.Is it unusual for an insurance co to try and collect from an individual(they know I don't have much money) 3. Since I may have to pay the total cost of the truck plus all intrest and my boss has been making his ins. payments isn't the insurance co making out on this is this abnormal or just the way it works

Re: Coming after me for settlement Options?
1. Pleading poverty doesn't work in court, but it may work with the plaintiff if you make a settlement offer and explain why it's the best you can do.
2. Insurance Co's routinely try to recover from responsible parties.
3. Your boss got what he paid for, no more no less. The insurance co. bases its rates on what's covered, and you were apparently outside what it had agreed to cover.
Why is bankruptcy not an option? Have you considered whether there is any legal defense? You may want to consult w/ a lawyer.
