Legal Question in Insurance Law in Virginia

Contract

The siding of my home got damaged by windstorm/hail. I submitted a claim to my insurance company. The insurance company agreed to pay only for the damage. Since the insurance company couldnot repalce it with exact same, my homeowners association doesn't allow me to do any partial repair. I went back to my insurace company and requested to replace the entire siding. At first they asked me provide an estimate. So I hired a contractor and asked him to provide me an estimate. He wrote a contract that he gets the job provided the insurance company pays for it. The insurance company denied to pay for my entire siding.

I have two question

Can I take legal action against my insurance company?

My contractor is now threating me that I should get the repair done with him even if the insurance company doesnot pay otherwise he will take legal action.

If you hired the contractor to provide an estimate for the repair, that's all that you're required to pay him for.

Whether or not you can take action against your insurance company depends on the provisions in

your particular written policy which should spell out whether the carrier is responsible for

paying for the repair of this kind of damage under these particular circumstances.
