Legal Question in Insurance Law in Virginia
Farm Animal Accident
I hit a farmer's cow when driving, and it caused thousands of dollars worth of damage to my truck. The farmer acknowledged to myself and the police officer that it was his cow, but his insurance company will only pay part of the damage, and I had to pay $5000 out of my pocket to complete the rest. Does the farmer legally have to cover the entire cost of repairing my truck if it was his cow?

Re: Farm Animal Accident
If the cow was in the path of your truck due to the farmer's negligence and you yourself in no way contributed to the accident by way of your own negligence, then the farmer should legally be responsible for all of the damages to your truck resulting from this accident, and you should be able to sue him and recover the additional $5000(or an amount close to it) in a Virginia small claims court.
