Legal Question in Insurance Law in Virginia

No Fault Car Accident

I was the fourth car in a four car accident. Damage to the front of my car. I have pain in my wrist and neck. Did not go to the hospital, it was christmas day.

I called my insurance co. They want to total my car, but I will still have to make payment to the car company. I want them to repair my car. What can I do?

Also, if the first car stopped short causing the accident, can I be sued?

Re: No Fault Car Accident

Your insurance company is not required to pay you more than the fair market value of the vehicle at the time of the accident. If repairing the vehicle would cost more than fair

market value of the vehicle, all you can expect is the latter, even though that will not cover what's owed on the outstanding note.

Whether you yourself could possibly be sued by one of the other drivers could only be determined after a very close examination of all the relevant facts, but it would not appear likely, if the facts are as you claim.
