Legal Question in Insurance Law in Virginia
hipaa
I work for a health ins. in VA. Specfically for a Federal plan. My step children are covered under the same federal plan in WV through their mother. I have HIPAA release on file for the children. Step son getting sued from a hospital in WV for a bill and asked I look in to it. When I checked on it on Monday I found that the claim didn't process correctly so I called the plan in WV and advised them of the guideline and to please process the claim. It has now come to my attention that the plan in WV called the director's office and reported me as a possible HIPAA violator. I never accessed anything that I didn't have a release for and I never did anything I wasn't told I couldn't do by our HIPAA person in my office. I don't feel I have done anything worng or anything to violate the privacy laws, but it's a scary thought to think that this is happening.

So, let those in the director's office process your denial of any wrongdoing with respect to alleged HIPAA violations along with(hopefully) your step-son's hospital claim.
