Legal Question in Insurance Law in Virginia

Insurance Company Claim they made a mistake

The insurance company that hold my cancer policy originally denied my claims back in 2003. In 2004, my doctor wrote them a letter of appeal, and they approved my tumours as cancer and have been paying me out on my policy for my surgeries and hospitalizations I've had to endure.

Now suddenly, they denied my last claim, saying they made a mistake in approving the appeal 2 years ago, and shouldn't have paid me anything to begin with. I have proof of their payments, and they even approved another payment after initially telling me they had made a mistake and would likely not approve any further claims.

Can they do this and do I have a case against them to have my denied claims paid and future ones paid also?

I have two cancer policies (different companies), and the other company have not acted in this way...

Re: Insurance Company Claim they made a mistake

You should have an attorney review the terms of your policy which is at issue as well as the relevant facts regarding your carrier's past conduct. Chances are, however, that the carrier can get away with what they're doing and leaving you with virtually no recourse.
