Legal Question in Insurance Law in Virginia
Insurance wants to Total my Truck
I have been rebuilding a 78 Ford 150 for the last 2 years.
On sunday a Honda Civic crossed in front of me causing a serious accident,
The driver of the Civic has accepted liability and her Insurance Company want to Total my truck.
They have not made an odffer yet but based on what has been said I dont believe they will offer full or fair value ( from my perspective ) How much control do I have in the negotiations at this point? I can provide all the reciepts of the wark done and the parts bought. Can I tell them what I want and stand firm?
Thanks

Re: Insurance wants to Total my Truck
Sure, you can tell them what you want and stand firm. Unfortunately, however, the real world of
insurance settlements does not and will not assign a teribly high value to a vehicle originating in the year 1978, no matter how many receipts you can produce showing your many improvements and additions of equipment to the vehicle over the years.
And your control over these negotiations is very minimal since even if you took the matter to court a trier of fact would probably give you no more than what the insurance carrier may offer.
