Legal seperation laws after death regarding retirement benefits
My boyfriend has been legally separated for four years. Was married for 26 years. Wife repeatedly cheated on him. His verbal wishes were that this women would not get any retirement money. He has 7 grown children. Life insurance is in forth son's name. My question is, if the separation agreement states that she is not to receive any retirement money is this still a legal agreement after death? He passed away August 1st of this year. He was 49 years and died of a massive heart attack.

Once the wife signed the property settlement agreement, knowing full well that she was waiving her right to claim any of her husband's retirement pay, she waived that right forever, regardless of whether the husband was alive or dead.
