Legal Question in Insurance Law in Virginia

neighbors insurance

Our neighbor's hot water heater busted and flooded our kitchen and carpet. I didn't have insurance at this time but contacted his insurance company, and they told me to get quotes on repairing. After getting them all the info they needed, now they are telling me that they are going to pay only 60% or the repairs and I am responsible for the rest even though all I want done is getting my stuff back the way it was before the flood. We are replacing carpet with 20% we have to pay which is 2 1/2 yrs old and cabnets which we have to pay 40% because of the age which is 15 years old. Should his insurance company pay for the other or should we try to contact him for the difference?

Unless your neighbor's homeowner's policy provided for full replacement value for the damaged items(unlikely), his insurance carrier

is going to limit its payment to the estimated fair market value of the items at the time the loss was incurred---which, basically, would be no more than the amount you could sue the neighbor for in small claims court, if you decided to go that route.
