Legal Question in Insurance Law in Virginia

Security Deposit Kept without prior notice

On May 2, 2007 driving a taxi cab for Yellow Cab of Williamsburg, She went back into the house, the lady living in the house across parked directly across the street in front of her drive way. When she got back in the cab without realizing that I had not pull up in her driveway, I backed out, tap the other car. That happened on May 2, 2007, I quit on November 9, 2007. Never once was I told this lady filed an insurance claim, the damage was no more than One Hundred Dollars. Every driver has a Seven Hundred & Fifty Dollar deposit, this money earns no interest. I asked Pat, how can you take money from someone for an accident that happened in May, he said, ''There is no Statute of Limitation on when he can take my money.'' I was told that the insurance company just fax the bill to him on November 29, 2007, for a month I was not told that Seven hundred forty-five dollars would be taken out of my deposit, without an explanation. The lady was insured with USAA, she moved to Ocean City, MD in August or September, her estimate was dated 5/16/07.

There was old damage to her car, almost eight months later they take my money? I paid Four Hundred

Thirteen Dollars a week plus gas, Yellow Cab for the lease. I will be sixty-five years old

Re: Security Deposit Kept without prior notice

So, the lady claimant's estimate was for how much cost to repair the damage, was there more than one estimate, and how do you know that the damage which you allegedly caused was in fact no more than $100? And, what was the nature and extent of the "old damage" which you allege was preexistent (to this accident) on her vehicle and how have you made these determinations?

If you don't have (or can't get) the answers to these questions, the forfeiture of your cab driver's contingency damage deposit was probably justified.
