Legal Question in Insurance Law in Virginia

Statue of Limitation deadline next week

My wife was in a car accident 2 years ago and is still receiving treatment. (not a major illness, but back pain. neck pain, headache etc).

As she was still receiving treatment, we had not filed a claim till now. About a month ago, we did put all the paperwork and medical costs together and sent it in to the insurance for a claim.

Now, the insurance is claiming that they have not received some statements from my health provider that they requested and the statue of limitation is expiring in a week.

What can I do at this point? Is the insurance company purposely stalling? What happens if the time runs out? (next week)... would they have to settle before that?

If I do go to a lawyer, what would I need to do? (general sue or have to have all the details worked out?)

Please HELP!!!

One year and 51 weeks and you are still asking "IF" you go to a lawyer??!? What are you smoking?? Do you have this fantasy that the insurance company will "settle" or do anything other than let the clock run out??!! You had better retain a lawyer TODAY. Why didn't you go to a lawyer the day after the accident???!?? Your LAWSUIT needs to get filed TODAY. No more do-it-yourself wannabe amateur legal work, you have screwed things up almost beyond repair. No lawsuit filed by the deadline, your wife gets nothing, you get nothing, and the insurance company gets to laugh at you. I will laugh at you, too.
