When are you unable to decide?
Can a person with a blood alcohol level of .23 be considered to have been able to make a rational judgement when getting into a car with someone else who may have been drinking.

Maybe, maybe not, depending upon many other factors(other than the BAC itself), including the .23er's age, gender, size and weight, general tolerance for and prior history of drinking alcohol, etc.
