Legal Question in Employment Law in Virginia

401K v. Roth and contract

Dear Law Guru:

I was recently offered a job. During negotiations, I specifically asked about availability of a Roth 401K. The offeror and interviewer (same) stated that a ROTH 401K was available. As I expect my income to increase, I felt encouraged, and eventually, hours later, accepted the offer.

I learned after hiring that a ROTH is not available. According to charlesschwab and other analyses, this could cost me $100,000 over 20 years.

I do not wish to lose my job, but I do wish to challenge, and renegotiate. I fear that if I do inquire, the interviewer/offeror will deny my assertion. I have my own personal notes, and research I performed PRIOR to interview.

Please keep confidentil and assist. Thank you.

Re: 401K v. Roth and contract

I see no harm in making further inquiry of HR (or whoever)regarding the matter. Perhaps, the interviewer merely made a mistake regarding the availability of the Roth 401K.
