401k vesting
If an employee is vested, but embezzles from the company, can the company withhold the amount that it matched in the program?

Maybe, but more information would likely be required for a more definitve answer, such as whether the employee had actually been convicted of the crime alleged and whether the employer may have obtained a civil judgment against the employee for the amount embezzled.
