Legal Question in Employment Law in Virginia

I accepted a job in sales last October. When the offer was made it was stated I would receive a base salary and commission on sales. I failed to ask for the offer in writing. To date March 27 I have not received any commission on sales. When I question why I keep being told they are working on a Sales Agreement. They keep telling me it will be ready in a week or two. Then a month goes by and no agreement. Do I have any legal recourse?

Sue for what you're owed before the sum exceeds $5K and you're forced to

pursue your claim(s) in regular general district rather than small claims court.
