Legal Question in Employment Law in Virginia
automatic deduction of 30 min.
With out any notice today my employer informed me effective today. That any time over 6 hours of work 30 min. will be deducted break or no break. In my line of work as a chef I have not had a 30 min. break in the past year and a half with this company or any other restaurant. Can they take the 30 min. legally w/ or w/out break? They claim according to the hand book 6 hours constitutes a full work day and a 30 min. break. They say because the company that writes the hand book and pay checks is in California we do not follow virginia labor laws. Is this true?

Re: automatic deduction of 30 min.
No, that is not true; Virginia labor laws apply anywhere employee work is actually being performed in the commonwealth that is intended to be covered by these laws, irrespective of where the company is located that issues employee checks and supposedly wrote the company handbook.
