Legal Question in Employment Law in Virginia

Backround Check and Expungement

When I was younger I was arrested once, and the record was expunged. Now recently at my job we've had a background check, which I passed. Unfortunately, we're coming on a second background check, this one involves fingerprints and an ''FBI Check.''

Now, I have only been arrested for this one incident, it was in another state, and my record was expunged almost a year ago. I know for a fact that my record is pretty much ''invisible'' in that county. Is there a chance this could turn out bad for me?

What do you think will happen?

Re: Backround Check and Expungement

If as you claim the record of your conviction for a crime in some other state was in fact "expunged", the record of your arrest and fingerprinting, nevertheless, would likely remain somewhere in some law enforcement database.

Consequently, whether or not the FBI's datamining will pickup on this likely still extant factoid during the course of their check on you is, I would submit, simply unknowable at this time.
