Legal Question in Employment Law in Virginia

Boss Changed Retirement Benefit Plan

I just found out from our payroll accountant that my employer (a dentist) changed his employees Retirement Benefit plan two years. He moved from a Profit Sharing plan into a Defined Benefit Pension Plan which I was not aware of. Can he change my retirement plan without notifying me? Does his action violate the ERISA? If so, what is my course of action? His practice is in Alexandria, VA.

Re: Boss Changed Retirement Benefit Plan

You should review the paperwork connected with the plan which should contain some reference to your rights with respect to this issue. And, if you're unsure as to what the paperwork says, then take it to an attorney for his or her review

and who should be able to further advise you.
