Legal Question in Employment Law in Virginia

breach of employment contract

I was a commissioned sales person, employee not independent contractor. What has transpired to date would take more space than available to address here, however, I have very well documented proof. I was fruadulently induced by the employer as well as put in a financial position of duress wherein they terminated my original employment contract under which I was hired for another. It just got worse from there. My question is that I have heard that Virginia is a very pro-employer state. I am seeking the real statistics on the chances of prevailing in a court action due to the fact that these cases are never taken on a contingency fee? Can anyone shed some light on whether the little employee can prevail against corporate America in the state of Virginia when the case has merit and well documented with proof of the charges?

Re: breach of employment contract

If the "little employee" has a contract which his employer has clearly breached, the former has a much better chance of prevailing in this corporation favoring Commonwealthon on his wrongful termination/contract breach claim than the hapless folk who have also been terminated under similar circumstances but without the protection of a contract or collective bargaining agreement on which to base their legal recourse.

Of course, whether your particular claims are meritorious and well documented remains to be proven beyond your mere assertion.
